The steps of a purchase in Spain

Do the sums

Add between 10% and 13% to the price for taxes and costs. Banks usually lend up to 80% to residents and less to non-residents. Calculate

If you come from abroad: NIE and bank account

To buy you need a foreigner's identification number (NIE). You apply for it at the police or at the Spanish consulate in your country.

Check the paperwork

Land registry extract, community and property tax debts, energy certificate and, for country houses, the planning status. An independent lawyer checks it for you.

Deposit agreement

It is signed by handing over a deposit, normally 10%. Put in writing the deadline, who pays each cost and what happens if the bank does not grant the mortgage.

Deed before a notary

You pay the balance, receive the keys and the purchase is entered in the Land Registry. Then come the tax and the change of utilities.

Frequently asked questions

What taxes does the buyer pay?

On new builds, 10% VAT plus stamp duty. On resale properties, transfer tax, set by each autonomous region (generally between 6% and 10%).

Can a foreigner buy?

Yes, without limits, whether resident or not. They need an NIE and, every year, will pay property tax (IBI) and non-resident tax on the home.

Who pays the agency?

The seller usually pays their fees, but something else can be agreed: ask before viewing.
